**Serbia’s Military Aircraft Overflight Request Rejected**
The Minister of Defense of Bosnia and Herzegovina, Zukan Helez, has refused to grant approval for a Serbian military aircraft or helicopter to fly over the country. The request was made by the Serbian Embassy in Bosnia and Herzegovina for January 8 and 9, 2025.
Helez informed the Office of the High Representative (OHR), NATO Headquarters in Sarajevo, EUFOR, and the EU Delegation to BiH about his response. He stated on Facebook that he had refused approval because the overflight suggested an intention to attend events related to the celebration of January 9, which was declared unconstitutional as the Day of Republika Srpska by Bosnia’s Constitutional Court in 2015 and 2019.
The minister emphasized that disregarding the court decisions undermines the rule of law and could potentially be a criminal offense. Helez also stressed that all signatories to the Dayton Peace Agreement, including Serbia, guaranteed compliance with its provisions, including Annex 4 which establishes jurisdiction and the finality of Constitutional Court decisions.
Helez pointed out that by ratifying the “Declaration of the All-Serb Assembly,” which disputes the Constitutional Court’s decisions, Serbia is creating a potential breach of the General Framework Agreement for Peace in Bosnia and Herzegovina. This could have unforeseen consequences for peace and stability.
The minister concluded by calling on the authorities of the Republic of Serbia to respect the parliamentary, judicial, and other decisions of Bosnia and Herzegovina’s institutions and bodies.
