The secrecy was not violated in the elections on October 26. According to the Vice-Speaker, Giorgi Kakhiani, when a voter is in a voting booth and chooses a candidate, no one can see their decision.
According to Kakhiani the judge Vladimer Khuchua should have first determined at least one thing, that when a voter was in the voting booth and voted, whether anyone was observing or not.
Kakhiani claims that the judge doesn’t even judge these facts.

More than 2,000,000 people participated in the elections. I don’t recall anyone complaining that their vote wasn’t kept confidential. Legally, secrecy means that no one can see the voter’s decision when they are in the voting booth and color the candidate of their choice. I have never heard of such a case. There was only one case of this kind, and it turned out that the representative of “National Movement” had also been observing the voter.

A member of the family of this judge is a vocal opponent. If it is proven that Aleko Elsashvili was aware of the judge’s decision in advance, then this is a questionable situation and should be investigated. Giorgi Kakhiani said that it is a serious offense if someone knows in advance the decision of the judge.
The Tetritskaro Court confirmed that the vote secrecy was violated. Judge Vladimer Khuchua accepted GYLA’s complaint and annulled the electronic district results in Tsalka, Tetritskaro and Tsalka districts.
Khuchua explained that the court believes unequivocally that the voter had no right to vote. According to him it should be possible, once and forever, to manage the electoral environment and administration so that any manipulation or illegal interference is excluded, and not dependent on anyone’s goodwill.
