Constitutional expert Vakhtang Khmaladze says the Georgian Parliament has no right to vote on its own authority. He believes that with this vote, they have put themselves outside of the constitution.
In an interview for “PalitraNews”, Khmaladze explained that if the Constitutional Court had not allowed lawsuits against the current parliament session, then it would have been legitimate for them to convene. However, since the court did allow these lawsuits, the parliament should not have voted on their authority.
Khmaladze called this action a form of government seizure, which is prohibited by the constitution. He emphasized that all possible mechanisms should be used to prevent such actions in the future.
When asked about the possibility of filing a claim with the European Court of Human Rights, Khmaladze said it’s only possible if there are the right plaintiffs. He noted that different groups and entities can appeal to Strasbourg regarding the elections.
Khmaladze sees re-elections as the way out of the current political crisis. He believes that this is a simple solution written in all constitutional law textbooks, but not included in the “Georgian Dream” chapter.
